The refuge comes after the Second World War with the high mortality observed in Europe by totalitarian regimes. In 1950, UNHCR was created to address the issue of refugees. The definition of the term is in the 1951 Convention, however, it does not cover environmental refugees, leaving such delimitation to the doctrine and academic research. Migration through the sea is often done in an irregular way, bringing many dangers to the migrants. This article aims to analyze the issue of environmental refugees and migration through the sea as challenges of contemporary international law made using articles, legislation and international news that address the issue.
