The contemporary scenario of the great migratory flow in the 21st century reveals global socio-cultural, economic and political issues, reflecting the realization of human rights for refugees who are moving in search of better living conditions and protection in other states. It is known that equality is the basic principle of a Democratic State of Right and grounds the need to protect the rights of people, regardless of their condition. From this, the justification of this study is framed. Afterward, this is a topic related to International Law in growing relevance. In this sense, it is sought to demonstrate through bibliographic research and hypothetical-deductive method, the legislative advance caused by migration and its real application in Brazilian law as a consequence of the realization of Human Rights in the international panorama.
