THE The unfinished journey:
narratives and contradictions of a linear reading of the evolution of the modern State

This article critically analyzes the predominant narrative in legal doctrine regarding the evolution of State models. Based on the historical-deductive method and a bibliographic review of classic and contemporary authors, it argues that the succession from the absolutist State to the democratic rule-of-law State does not represent a linear process of overcoming, but rather a pathway marked by overlaps, ambivalences, and continuities. The reading that identifies a continuous advance between models – from liberal to social, culminating in the constitutional – tends to obscure structural conflicts that remain latent in contemporary democracies. The hypothesis advocated is that the current constitutional model constitutes an arena of dispute between irreconcilable foundations, such as freedom and equality, efficiency and solidarity. Instead of rupture, a dynamic reconfiguration of paradigms that remain under tension is observed, revealing the incompleteness of the democratic State project and the centrality of the State as a mediator of structural contradictions in society.
