Abstract

This paper aims to analyze the arguments of Captain Domingos da Silveira and his attorney Antônio Henriques de Sá, thar considered the sentence imposed by the City Council of Natal in 1718 to be unfair to the captain. Silveira was “caught” in the municipal “correição”, for having violated the “Postura” that prohibits the leaving of captaincy flour without a license and for that reason his flour was confiscated, in addition to being taxed. In that period, there was only one Council in the city of Natal, which was responsible for managing the entire captaincy, one of the main tasks of the Council was guarantee the supply provide to maintain the commonwealth. Considering that the period studied is inserted in the so-called "Guerra dos Bárbaros" period. The time frame of this paper is 1718 and 1719, the first data refers to the “correição” and the second to the grievance. The main source used for this research was the “Livro de correições do Senado da Câmara de Natal”. The basic methodology in these investigations was examine the legal order made by the concil, the tabulation of sources and the quantitative and qualitative analysis of corrections.
