Legal instruments to incentive micro and small businesses:
analysis through public procurement

This study analyzed incentives for small businesses through public procurement. It was found that, compared to the experience of other countries, Brazil is quite advanced in this area, resorting to legal provisions for this purpose. However, although the benefits to the national economy of favoring micro and small businesses are fully accepted, and the evidence collected, particularly a case filed with the Federal Court of Auditors (Tribunal de Contas da União [TCU]), TC 036.346/2019-5, suggests the advantage of using the benefits provided for in Complementary Law (Lei Complementar [LC]) No.123/2006, which favors micro and small businesses in public procurement, a lack of periodic assessment of using these mechanisms and a defined methodology, as well as the unavailability of data capable of supporting a conclusive analysis on the topic, reveal a deficiency in the elements needed to support public administrators’ decision-making with regard to the applicability of some of these instruments. Far from being an obstacle to the policy of promoting micro and small businesses through public procurement, it represents an opportunity to improve the existing scenario.
