Judicialização do acesso a medicamentos no Ceará e biopolítica

The purpose of the present work was to analyze the relationship between the medical and legal powers in the promotion of the right to access to medications in the State of Ceará, in light of the concept of biopolitics developed by Michel Foucault. The study departed from the documentary analysis of lawsuits filed against the Health Department of the State of Ceará (SESA) or against the Municipal Health Department (SMS) of the municipality of Fortaleza, from 2014 to 2017. These lawsuits claimed rights to free access to medications for the treatment of chronic degenerative diseases. A discourse analysis under the Foucaultian perspective was used to identify the points of view of the actors involved in the judicial processes, and to examine the different ways in which discourse plays a role in strategic systems. Results and discussion: In the analyzed cases, the State conditioning was observed to the evidences of the market, Medicine and Judiciary. Brokered to medical discourse, the magistrate's discourse was glimpsed around human life in the search to normalize it. Conclusion: This work beckons to the necessity of conducting deeper investigations that allow the construction of measures capable of making the political subject society in the biopolitical context. The existence of a demand for medications with the Judiciary demonstrates the interference of this in the decision making of public health policy in Ceará.
