Abstract

The present paper refers to the penitentiary theme. It is indisputable that prisons are often an invisible problem, but their social impact, although neglected on many occasions, is quite massive. Everything that happens within prison institutions ends up having an important effect on the community in which it is inserted. Thus, the importance of prison rehabilitation and treatment is demonstrated and the reasons behind its constant and apparent failure are understood. The fundamental basis of our thinking can be found in the writings of Michel Foucault, a French thinker and philosopher who offered important contributions to criminological science, particularly through the analysis of prison systems and their errors. In this article, we analyze them under philosophical lights (those of Foucault himself), but also under a criminological point of view with the aim of understanding how it is possible that an institution so old that does not fulfill the commandments that were given is still active and more and more demanded by the day.
