CIVIL DISOBEDIENCE AND THE QUESTION OF ITS LEGITIMACY

Abstract

This article deals with the problem of civil disobedience, and it has the
intention of analyze in what extent an illegal action committed to challenge an unjust law can be morally justified. We start from the historical description of the emergence of the analyzed phenomenon and present a definition. Later, we expose how civil disobedience was understood by Thoreau, Rawls, Arendt and Habermas that dealt with the justifications for their practice. We argue about how civil disobedience could help improve the democratic system by functioning as a corrective against injustice. We conclude by highlighting aspects of phenomena that looks like but are not civil disobedience.
