THE POSITIVE, THE REAL, THE NARRATIVE: LEGAL TRUTH AND NORMATIVE INDETERMINATIONS FROM A PHILOSOPHICAL-LITERARY VIEWPOINT

The purpose of this article is to carry out a transdisciplinary study that addresses the problems related to the indeterminacy of the language of norms and the search for truth in the legal sphere. Approaching – between Law and Philosophy – Kelsen, Hart and Taruffo, Nietzsche, Gadamer, Cover and MacIntyre, and – in Literature – the works ―The Merchant of Venice‖, ―Don Quixote de la Mancha‖ and ―The Trial‖, it is verified that the truth is validated by consensuses previously established from specific hermeneutic pretensions, and the judicial process is not, therefore, a legal instrument capable of bringing, necessarily, the formation of a single truth.
